Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you ("you", "your", "User") and ialae ("ialae", "we", "us", "our"), the operator of OmadMode, the website at https://omadmode.ialae.com, and all related applications, features, content, and services (together, the "Service"). By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Acceptable Use Policy, Billing & Refund Policy, and Health & Nutrition Disclaimer, each incorporated into these Terms by reference. If you do not agree, do not use the Service.

1. Definitions

  • "Account" means the account you register to use the Service.
  • "Content" means any data, text, inputs, preferences, recipes, images, nutritional estimates, and other materials made available through the Service.
  • "Generated Content" means recipes, meal suggestions, nutritional estimates, images, and other outputs produced automatically by the Service in response to your inputs.
  • "User Content" means the inputs, preferences, and other materials you submit.
  • "Subscription" means a paid plan that unlocks additional features.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and legally able to enter into a binding contract, to use the Service. The Service is not directed to children. By using the Service you represent and warrant that you meet these requirements and that all information you provide is accurate and complete. We may refuse, suspend, or terminate access to anyone at our discretion.

3. The Service and its nature

OmadMode is an automated, AI-assisted tool that generates recipe suggestions, meal ideas, and estimated nutritional information based on the preferences and inputs you provide. The Service produces automated suggestions and estimates for general informational purposes only. It does not provide medical, nutritional, dietary, health, or professional advice, and is not a substitute for a qualified professional. You acknowledge and agree that:

  • Generated Content is produced by automated systems and may be inaccurate, incomplete, unsuitable, or occasionally unexpected, and is not reviewed by a human, chef, physician, or dietitian before you receive it;
  • calorie, macronutrient, allergen, and other nutritional figures are estimates only and may be wrong;
  • you are solely responsible for evaluating the suitability, safety, and accuracy of any recipe before preparing or consuming it, including checking for allergens and cooking food safely; and
  • your use of any Generated Content is at your own risk, as further described in our Health & Nutrition Disclaimer.

4. Accounts and security

To use most features you must register an Account and may sign in with email and password or a supported third-party login (such as Google). You agree to provide accurate information, to keep your credentials confidential, and to be responsible for all activity under your Account. Notify us promptly at contact@ialae.com of any unauthorised use. We are not liable for loss arising from your failure to safeguard your Account.

5. Subscriptions, fees, and billing

Certain features require a paid Subscription. Plans, prices, quotas, billing cycles, automatic renewal, cancellation, and refunds are governed by our Billing & Refund Policy, which forms part of these Terms. Payments are handled by our third-party payment provider; we do not store full card details. You authorise recurring charges until you cancel. We may change prices and plans on reasonable notice; changes apply from your next billing cycle.

6. Acceptable use

Your use of the Service is subject to our Acceptable Use Policy. Without limitation, you agree not to misuse the Service, interfere with its operation, attempt to bypass usage limits or security, scrape or harvest data, use it to generate unlawful or harmful content, or infringe anyone's rights.

7. Intellectual property

The Service, including its software, design, text, graphics, logos, and all underlying technology, is owned by ialae or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Service except as permitted by law.

8. Your content and licence to us

You retain ownership of your User Content. You grant ialae a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, and use your User Content and inputs to operate, provide, secure, and improve the Service (including generating meals for you). You represent that you have the rights to submit your User Content and that it does not violate any law or third-party right.

9. Generated Content

Subject to these Terms and your compliance with them, you may use the Generated Content produced for you for your personal, non-commercial cooking purposes. Generated Content may not be unique to you and similar content may be generated for others. We make no representation that Generated Content is original, accurate, suitable, or non-infringing, and you are responsible for your use of it.

10. Third-party services

The Service relies on and may link to third-party services (such as authentication, payment, email, analytics, hosting, and AI providers). We do not control and are not responsible for third-party services, and your use of them may be subject to their own terms and policies. Our sub-processors are listed in our Data Processing Agreement.

11. Health disclaimer

You acknowledge and agree to our Health & Nutrition Disclaimer in full. OMAD and fasting are not appropriate for everyone and the Service is not medical advice. Consult a qualified professional before changing your diet.

12. Disclaimers of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT GENERATED CONTENT (INCLUDING RECIPES AND NUTRITIONAL ESTIMATES) WILL BE ACCURATE, COMPLETE, RELIABLE, SAFE, OR SUITABLE FOR YOU. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL IALAE, ITS OWNERS, OPERATORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, OR DEATH, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY GENERATED CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING YOUR MANDATORY STATUTORY AND CONSUMER RIGHTS.

14. Indemnification

You agree to indemnify, defend, and hold harmless ialae and its owners and operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms or any policy incorporated into them; (c) your violation of any law or third-party right; or (d) any Content you submit.

15. Suspension and termination

You may stop using the Service and delete your Account at any time. We may suspend, restrict, or terminate your access with or without notice if we believe you have violated these Terms, created risk or possible legal exposure, or for operational, legal, or security reasons. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) survive termination.

16. Changes to the Service and Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may update these Terms from time to time; material changes will be notified via the Service or by email. The "Last updated" date shows when they last changed. Your continued use after changes take effect constitutes acceptance. If you do not agree, stop using the Service.

17. Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, outages, failures of third-party providers or networks, cyber-attacks, strikes, war, terrorism, or government action.

18. Governing law and disputes

These Terms are governed by the laws of Morocco, without regard to conflict-of-laws rules, and the courts of Morocco will have jurisdiction, except where mandatory law in your country of residence gives you the right to bring proceedings in your local courts or to rely on your local consumer protections, which remain unaffected. You agree to first contact us to try to resolve any dispute informally.

19. Miscellaneous

These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Notices to us should be sent to contact@ialae.com; we may notify you via the Service or your registered email.
